Only cask.  Even if someone did want to fill a growler ignoring the law, it probably wouldn't hold up too well.

Per MN State Law (340A.301), Surly Brewing will not be able to get a license to sell growlers in 2009. In 2008, we have sold over 3500 barrels of beer. The cut-off limit for getting that off-sale license is 3500 barrels. So, no more growlers, no more Darkness Day, and no more SurlyFest.
Here is the plan for wrapping up growler sales in 2008. The last week of December we will be selling growlers of a new beer we brewed specifically for this farewell to growlers. The beer is a DIPA ? double IPA. We do not have enough growlers left for you to purchase, so we came up with a new idea.
Bring in your empty growler and we will clean it and then fill your growler directly from the brite beer tank in the back. We will be selling these growlers for $17 each and here are the hours we will be filling:

December 27th ? Saturday noon-4:00
December 29th ? Monday   10:00-6:00
December 30th ? Tuesay   10:00-6:00
December 31st ? Wednsday   10:00-4:00
We have brewed 30 bbls of this beer. If we run out, we will not have any more to sell.

-All growlers must be returned by December 31st if you wish to get your $3 deposit back.

Don't tell me they can't come up with an alternative location for Surlyfest and Darkness Day.  This is one of those situations where "when there's a will, there's a way" seems appropriate.

Exactly.  Gonna be hard to come by the empty growlers to get filled.  Best bet is that anyone with a Surly growler currently mail it back to someone here to have refilled when the time comes.

Saturdays @ Noon - 2:00 and during tours
Limit of 2 growlers per brand. We try to have plenty of furious and bender on hand for customers. However, there are weeks that we have limited amounts of certain beers or even none.

Check out our new growler only beer below.

November 22nd - bender & furious
November 29th - bender & furious
December 6th - bender & furious
December 13th - bender & furious
December 20th - bender & furious
December 27th - bender & furious

does this mean these are the ONLY beers available for fill up those days or there are others as well?

Those are the only ones available.  Sometimes you get lucky and they will happen to have a couple special growlers but you don't know til you show up.

Hello Wisconsin! Surly is coming. Finally, a good reason to visit Wisconsin.
An old girlfriend of mine bought me a homebrew kit back in 1994. She was
from Milwaukee. Wisconsin, we are now even. And no, you are not getting
cans. We will be tapping a keg of Darkness at Paddy Ryan’s Pub in Hudson on
Wednesday, November 19 at 7:00. After that, look for our beer in Western
Wisconsin: Hudson, Chippewa Falls, Menominee, Eau Claire. When I have an
idea of what bars are pouring our beers, I will put them up on our Surly
Bars page. Sorry Grynder, but the Madison/Milwaukee area is not getting any
Surly beer.
Goodbye South Dakota. I just got back from tapping Darkness at Monk’s in
Sioux Falls. The beer was flowing and it was great to see folks come out
from all over South Dakota for the event. Thanks to Jamie and Jerry for
getting Surly on at a great beer bar. If you are ever passing through Sioux
Falls on I-90 or I-29, stop by Monk’s. It’s one of the best beer bars I’ve
had the pleasure of drinking at (and they also have Surly).
Hello to Smoke. We are tapping the first keg of 2008 Smoke at Mackenzies Pub
in downtown Minneapolis. The fun starts around 7:00 next Tuesday, December
25th. 
Lots of folks are confused about what is happening with our tours and
growler sales, so I will explain. -----Tours will continue next year and are
unaffected by any changes.
-Growler sales will discontinue at the end of this year. Here is the deal.
Per MN State Law (340A.301), Surly Brewing will not be able to get a license
to sell growlers in 2009.  In 2008, we have sold over 3500 barrels of beer.
The cut-off limit for getting that off-sale license is 3500 barrels. So, no
more growlers, no more Darkness Day, and no more SurlyFest.
Why no more Darkness Day you ask? Selling 750s of Darkness falls under the
growler exception. Since we cannot get that license, we cannot sell Darkness
at the brewery.
Why no more SurlyFest you ask? For both Darkness Day and Surlyfest we were
able to pull temporary licenses to sell glasses of beer at the brewery. The
cutoff for that is also 3500 barrels.
If folks are really bent out of shape about these issues, you can tell your
state representative you want to change the law.

Is there any talk in MN about getting this flawed law fixed?

This is obviously going to effect every small brewer who meets any measure of success.  It seems to me that the arbitrary focus here is on the barrels produced and has nothing to do with the nature of the business.   I think that the legislature has to begin to look at brewers in the same way as they look at restaurants and taverns.  How do you go about convincing them of that?

I don't see this law as being a benefit to anyone, least of all the state.

There's talk about it and it's one of the many things the MN Craft Brewers Guild is working to change.  When and if it'll change I have no clue.  There's lots of complaining about it but not much in the way of people doing anything about it (other then the Brewer's Guild).

It's the Zoo. Surly Nation has spoken! We had a party for Darkness Day volunteers last night and they decided that Surly will donate $2500 from Darkness Day to the Minnesota Zoo. Thanks to all the folks that came to Darkness Day and the volunteers that made it a great.

We have gotten a pretty positive response for our new growler-only beer, 16 Grit. It is our Double IPA we brewed just for release in growlers. Because so many people have been asking about this beer, I have decided to order 500 more growlers so we will have them available for sale at the end of December. In other words, you will not have to have an empty growler to purchase this beer.
Why the name 16 grit? It is an homage back to the old abrasive factory that was the precursor to the brewery. (See the history page for more details about that.) We would use different sized abrasive grains to differentiate the aggressiveness of the sanding discs. 16 grit is pretty abrasive, kind of like a DIPA.

It should be funny to read the stories about people on bikes crashing and breaking their growlers.  As much as I like biking, doing it in the winter on a bike with a really thin tire through snow while carrying a bunch of cargo is never a good idea.
